Terms of Service

1. Who we are, and what this is

CatHerd is operated by Daniel Newell d.b.a. AppsByDan ("we", "us"). These terms are the agreement between you and us for your use of the CatHerd apps and the CatHerd website (together, "CatHerd"). By creating an account or using CatHerd, you accept them. If you don't accept them, please don't use CatHerd.

2. Who may use CatHerd

You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher, to use CatHerd. By using it you confirm you meet that requirement and that you are able to enter into this agreement.

3. Your account

You sign in with a Google account or an email address. Keep your sign-in secure — anything done through your account is treated as done by you. Give us an email address that reaches you; we use it to identify you to the people you share Roundups with, and it's how we'd contact you about a payment.

4. What CatHerd does

CatHerd helps a group organise a get-together, which we call a Roundup. A Roundup can include RSVPs, a shared checklist, group chat, and — if you turn it on — a live map showing where participants are.

5. Sharing, and what other people can see

Anything you put into a Roundup — your RSVP, checklist items, chat messages, your name and profile picture — is visible to the other people in that Roundup. Only to them: Roundup content is not public, and we don't sell it or show it to anyone outside the Roundup.

Location sharing is off until you turn it on. When you turn it on, your location is shared with the other participants of that Roundup, and only for as long as you leave it on. You can stop at any time, and leaving a Roundup stops it. Your profile never carries your location.

Use of location must be reasonable and consensual. Do not use CatHerd to track, follow, harass or intimidate anyone. We will terminate accounts that do.

6. Your content

What you create in CatHerd stays yours. You give us only the permission we need to run the service: to store your content and show it to the other people in your Roundups.

You are responsible for what you post, and you confirm you have the right to post it. Don't use CatHerd to post anything unlawful, threatening, harassing, hateful, or infringing on someone else's rights, and don't use it to send spam.

7. Things you agree not to do

Don't break the law with CatHerd. Don't attempt to access other people's accounts or Roundups, interfere with the service, scrape or bulk-collect data from it, or reverse engineer it beyond what the law expressly permits.

8. Buying things

In the apps. Purchases made in the Android or iOS apps are sold through Google Play and the App Store and are subject to their terms as well as these.

On the web. Purchases made on our website are sold by Daniel Newell dba AppsByDan directly. Payments are processed on our behalf by Stripe, through RevenueCat Billing; we never receive or store your card details. Where sales tax or VAT applies, it is shown at checkout and added to the price.

Subscriptions renew automatically at the then-current price until you cancel. Cancelling stops the next renewal — you keep everything you've paid for until the current period ends. You can cancel any time from Profile → More Roundups → Manage subscription in the app, or through the store or Paddle account you bought from.

9. Prices may change

We may change our prices. If we change the price of a subscription, the change takes effect at your next renewal and never in the middle of a period you've already paid for. We'll tell you before it happens.

Roundups you have already created are yours to keep. If your subscription lapses, you keep full access to everything you've made — you just can't create new Roundups until you renew or buy a single one.

10. The service is provided as it is

We work hard to keep CatHerd running and accurate, but we can't promise it will always be available, uninterrupted, or error-free. CatHerd is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows.

CatHerd is a planning tool, not a safety service. Don't rely on it for emergencies, and don't rely on the live map being current — locations depend on phones, batteries and networks we don't control.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of CatHerd.

Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or US $20.

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the statutory rights your local law gives you.

12. Ending things

You may stop using CatHerd at any time and delete your account from within the app or here on the web. Deletion is final and takes effect after 30 days, during which you can change your mind by signing in again. After that, your account and its data are permanently removed.

We may suspend or terminate an account that breaks these terms, that we're legally required to act on, or that is being used to harm someone. Where it's reasonable to do so, we'll tell you why.

13. Changes to these terms

We may update these terms. If a change is significant, we'll give reasonable notice before it takes effect. Continuing to use CatHerd after that means you accept the updated terms.

14. Governing law

These terms are governed by the laws of Arkansas in the U.S.A., without regard to its conflict-of-laws rules. If you're a consumer, this doesn't deprive you of the protection of the mandatory laws of the country you live in.
